ORDER TO VACATE AND CLOSE AND REPAIR OR DEMOLISH DWELLING To: OWNER (S) AND/OR PARTIES IN INTEREST BASED UPON PRIOR CITY INSPECTION, COMPLAINT AND NOTICE OF HEARING, and evidence presented at a hearing 11/11/09, the undersigned Housing Code Inspector makes the following findings of fact with regard to the above-described structures: (1) That the structures are unfit for human habitation and are found to be in violation of the Housing Code of the City of Rocky Mount. (2) That the structures are dilapidated in that the cost to make the repairs, alterations or improvements necessary to bring them into compliance with the Housing Code and to make them fit for human habitation exceeds forty percent (40%) of the value of the structure. NOW, THEREFORE, UPON THE FOREGOING FINDINGS OF FACT, IT IS HEREBY ORDERED: (1) That the structure listed above either: (a) BE REPAIRED, ALTERED OR IMPROVED on or before 12/11/09 to comply with the minimum standards established by the Housing Code, or (b) BE REMOVED OR DEMOLISHED on or before 12/11/09 If the structure does not comply with the Housing Code by the aforesaid date, the City will secure a title certificate and a repair estimate from a contractor at an estimated cost of $275.00, which will be assessed against the property. After the above is secured the City Council will issue a vacate ordinance, and the City will remove any occupants from the property and board up the structure. The cost of the foregoing will be assessed against the property. The Housing Code Inspector will proceed to request City Council to issue a demolition ordinance. After this is ordered, the City will proceed to vacate and demolish the structures. After closing and/or demolition occurs, the City Council will be requested to assess the cost associated against the property. This 12th day of November, 2009.
